1. Application Presentation
Heal is a mobile application for daily quotes and affirmations, published by:

The application is available on the Apple App Store and is intended for a global audience.
2. Acceptance of Terms
By downloading, installing, or using Heal, you unreservedly accept these Terms of Use ("TOU"). If you do not accept these terms, please do not use the application.
These TOU constitute a legally binding agreement between you ("the User") and the publisher of Heal ("us").
3. Service Description
Heal offers:
• Access to a library of positive quotes and affirmations
• Personalized daily affirmations
• Content available in multiple languages
The application works without account creation. No personally identifiable data (name, email, phone number) is collected.
4. Access to Service
4.1 Free and Premium Content
Heal offers free access to certain features as well as premium access via subscription or one-time purchase. Pricing terms are displayed in the application and on the App Store.
4.2 In-App Purchases
Purchases are processed exclusively by Apple via the App Store. Apple's TOU apply to any transaction. We do not have access to your payment information.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period, in accordance with App Store rules.
4.3 Refunds
Refund requests are to be addressed directly to Apple. We do not have the ability to process refunds ourselves.
5. Intellectual Property
5.1 Application Content
The entirety of Heal's content — original quotes, affirmations, design, illustrations, source code, trademarks — is the exclusive property of the publisher or is licensed to them.
Any content attributed to third parties (quotes from public authors) is reproduced for informational and cultural purposes, in compliance with the applicable right of quotation.
5.2 Usage License
We grant you a personal, non-exclusive, non-transferable, and revocable license to use Heal for strictly personal and non-commercial purposes.
5.3 Prohibitions
It is strictly forbidden to:
• Reproduice, copy, or redistribute the application content without written authorization
• Reverse engineer the application
• Use the content for commercial purposes
• Extract content automatically (scraping)
6. User Conduct
Heal is a consultation application. You agree to use the application in accordance with applicable laws and these TOU.
The application does not have any user-generated content features.
7. Personal Data and Analytics
7.1 General Principle
Heal is designed with a privacy-first approach. The application has no backend of its own and does not collect any personal data that allows you to be identified.
7.2 PostHog — Analytics
We use PostHog (PostHog, Inc., San Francisco, USA) to measure retention during onboarding and improve the user experience.
Data collected via PostHog includes:
• Anonymous events related to onboarding progression (steps viewed, time spent), without personal identifiers
• The response to the onboarding field "How did you hear about Heal?" — free text response, not linked to an identified profile
This data is anonymous or pseudonymized and does not allow you to be personally identified.
PostHog may store this data on servers located in the United States. The transfer is governed by appropriate mechanisms (Standard Contractual Clauses for European users).

7.3 Apple Data
Apple collects certain data via the App Store (downloads, purchases, crashes) in accordance with its own privacy policy. We only have access to aggregated and anonymized data via App Store Connect.
7.4 User Rights (GDPR / CCPA)
If you are a resident of the European Union, you benefit from the rights provided by the GDPR. If you are a resident of California, you benefit from the rights provided by the CCPA.
In both cases, since the data collected is anonymous, it is not possible to link it to your identity. You can nevertheless contact us at contact@healdaily.app for any questions regarding privacy.
8. Disclaimers and Limitation of Liability
8.1 Informational Content Only
Heal's content (quotes, affirmations) is provided for informational, inspirational, and cultural purposes. It does in no way constitute medical, psychological, therapeutic, or professional advice.
If you are experiencing mental health difficulties, consult a qualified health professional.
8.2 Service Availability
We strive to keep Heal available at all times, but cannot guarantee uninterrupted availability. Maintenance, updates, or technical events may cause interruptions.
8.3 Limitation of Liability
To the extent permitted by applicable law, we shall not be held liable for:
• Indirect, incidental, or consequential damages related to the use of the application
• Temporary unavailability of the service
• Decisions made by the user based on the application's content
For European Union users, these limitations apply in compliance with applicable consumer law.
9. Modifications to the Application and TOU
We reserve the right to modify at any time:
• The content and features of the application
• These TOU
In the event of a substantial modification to the TOU, you will be informed via the application or the App Store. Continued use of Heal after notification constitutes acceptance of the new terms.
10. Termination
You can stop using Heal at any time by deleting the application. Termination of a premium subscription must be done through your Apple account settings.
We reserve the right to suspend access to the service in the event of a violation of these TOU.
11. Applicable Law and Jurisdiction
11.1 Applicable Law
These TOU are governed by French law.
11.2 European Union Users
In accordance with European consumer law, more favorable provisions of the law of your country of residence within the EU may apply. Nothing in these TOU shall deprive European consumers of the legal protections to which they are entitled.
11.3 Non-EU Users (including USA)
For disputes involving users residing outside the European Union, and particularly in the United States, the competent courts will be those within the jurisdiction of Grenoble, France, unless otherwise provided by applicable law in the user's country of residence.
11.4 Dispute Resolution
In the event of a dispute, we favor an amicable resolution. You can contact us at contact@healdaily.app before any legal action.

12. Miscellaneous Provisions
12.1 Entire Agreement
These TOU, supplemented by the Privacy Policy, constitute the entire agreement between you and the publisher regarding the use of Heal.
12.2 Severability
If any provision of these TOU is found to be invalid or unenforceable, the remaining provisions shall remain in effect.
12.3 Non-Waiver
The failure to exercise a right provided for in these TOU does not constitute a waiver of that right.

These Terms of Use were written in French. In the event of translation into another language, the French version shall prevail.
